So around 30 to 40 deg ill start my truck and let it run for a few and then put in drive and head down the road but it doesn't want to shift into second right away. Is that by design to protect it self??

Mine did this for a while, but usually only when parked at in incline/decline. I believe it's just the choke being stuck on till you hit around +/- 20 mph (at least for me) After I put an exhaust on my truck it stopped doing it.
At what RPM is it going into second? I know when our trucks are cold they will hand higher RPMs till the engine reaches temp so could be that.
