Class action law suit against Cummins

Just received, by mail, a notice from Rust Consulting, Inc. out of Fairbault, MN concerning a class action law suit.

States: Anyone who purchased a 98 thru 01 Dodge diesel equiped with a Cummins ISB 5.9 liter built using a pattern 53 engine block could develop a crack on the passenger of the block causing a coolant leak.


Anyone had a problem, or has this been addressd before?

Rust Consulting INC.... That sounds suspect to me. Like when you sell a vehicle and then suddenly you get hundreds of recall and warranty letters about the car you just sold asking for money. (my wife actually sent it one time :facepalm: ) what do they suggest you do?

Hasn't this been an on going problem, most guys just fix it and move on....somebody is just fishing.

It sounds fishy to me, why would they be trying to do that lawsuit when those trucks are 10 years old now, instead of when they were newer?

If by fix it you mean sell the truck because it's got a bad block. Yes.
The evil '53' block is a known issue. I had not heard of legal actions against Cummins. I think it's fair and right though.

But as for the cracking some do and some don't head back over the fence to my side and talk to CajFlynn about his 1.1 million mile truck with a 53 block...

Yeah tho has been a known problem since 01 pretty much. I'm havein a hard time believing that it's taken this long for a lawsuit

I think a lot has to do with how 'hotrod'd' your hotrod is.

eah old news on those blocks, like Cody said its fixed by the end user and called done.

or you turn every issue into a mod...I seriously doubt that every single person who has had the crack has just thrown their hands up and sold the truck. I have one buddy who made it better and now he has a beast of a truck.
