As the title states, happy new year to me and my smashed 2017 RAM Sport. The guy pulled out turning left and smashed into my passenger side. After he hit me, he fled the scene. I whipped the truck around so fast and followed him. It was not pretty when he got out of the vehicle. It was hard to keep calm.

He has no issuance, non-driver state ID, and smelled like alcohol (he told me he was just drinking at the bar). My blood was boiling at this time. Luckily a lady witnessed the accident and followed me following him to check on me and yell at the guy! She gave me her contact info Incase I need it.

So here is my dilemma. The guy offered to write me a check-he told me to pick an amount. He pleaded and begged me to not call the cops as he would end up in jail and I would get no money to fix the truck. I told him 15K makes this all go away. He logged into his chase mobile app and showed me his savings account with 100K in it. He made a transfer from his savings account to his checking account. I verified and watched the transaction and saw the balance afterwords. He wrote the check and I did a mobile deposit into my account.

So, should I keep the 15K to pay for the damages or return the money, and call the cops?

By the way, I am OK. Not hurt at all. Just shook up from it and pissed.

Technically you've already settled with him and this is not a matter for the police or the courts...unless of course the check bounced.

Sorry to hear about the accident. Glad you’re OK. Unfortunately accepting and depositing payment already you might have locked the ending in stone.

You basically agreed on and accepted restitution.

I’d double check with an attorney for clarification though.

I'd say pay for the damages and call it a day. You'd still come out with money on top for anything else you needed. Seems sketchy but you have a witness, and you already have the money, so I doubt he would try to come back with anything on you.

Thanks. Do you think the damages are more thank 15K? I just don’t want to get screwed and have to pay for it. I did record a video of him explaining what happens and have a witness.

On second thought, you may have made out really good if that check doesn't bounce. If your new truck being damaged is an issue (which I'd understand) consider trading it in for a 2018 with a $15,000 down payment.

Thank you. I called Chase to verify the funds and they said it is available and won’t clear until Tuesday. I did ask if they could transfer the funds back and they said unfortunately yes. I am going to call tomorrow and Tuesday to verify again.

Honestly be glad you chased him down! Pissed can be a good thing and unless I'm missing something the damage doesn't look that bad (especially to the right dealer on trade-in).

Too bad that happened. Personally, due to my experience with alcohol related issues, his ass would have gone to jail. He probably didn't learn anything from this experience & has real drinking issues. Maybe next time he'll leave someone maimed or even dead.

Glad your ok, I would go first thing Tuesday and try to get estamintes on the cost to fix it.

Yeah. It took me a while to come to an answer. Even though I was so pissed I didn’t want to ruin his life - my conscience came into play. I felt bad and I know accidents happen so I was trying to be OK with him doing right and taking care of it.

Bud he can still walk away unless you have all of his info. The mobile to mobile takes a few days to process the people to people is instant. I have a personal banker that I just asked this question and that was her answer. Me it sounds like you settled it as long as he doesn't back out on you.

Yes I did get all of his info, a picture of his valid state ID, and recorded a video of him explaining what happened and as long as the check cashes everything is good and if it doesn’t I am calling the police to report the accident and calling the witness.

In some jurisdictions you do. Depends on local law and, obviously, how a local enforcement authority interprets the law, the actions of both parties and, in the end, the ultimate outcome.

Hopefully the inebriated driver doesn't kill someone in the near future.

Damn that sucks ....I'd go get a repair estimate prior to the check clearing . If the damage was less than $5,000 , I'd call it a day once the money cleared .

I certainly can see struggling with calling the law ....tough spot your in . Now this drunk can go drink & drive again , and maybe kill someone .
