I find it hard to believe that the first thing the lawyer said to you was to stop talking to the dealership and only talk to your lawyers. I've seen people hurt themselves doing that. Once you retain a lawyer, shut up and let your lawyer work.

Yes- the bank knows, but really all they cared about was getting their money back... literally. I will be asking about fixing my credit when it's almost all done.

How in the world would this effect your credit? I would be all over Chase about that if they are dinging you for what has transpired. Don't take their word for it either, in the next month get a credit report (they are free). If there is anything on it, pay your lawyer to send Chase a letter outlining the situation and to have any and all derogatory information removed. Then file a dispute with the credit reporting agency and send them a copy of the lawyer's letter.. I bit of a hassle, but worth it.

How I know..... I listened to a bank (shall remain nameless) and acted on their advice. It was verbal... lesson learned. Ran my report looking to sell our current house and get a larger one... ooops. Big enough ding to impact my mortgage number. Tried to file a dispute but it has been ignored and the bank denies ever making any kind of arrangement with me. Lesson learned. Always in writing and I now monitor credit quarterly.

Sorry if a bit off topic, but have been lurking on this one and it seems like you are on your way out of an ugly mess, but man that one part struck a nerve...

First, I have to agree that the husband IS the bad actor in this situation, however, it may also be true the dealer did not complete due diligence in the transaction.

I consulted a friend who has sold cars and he tells me that in these circumstances (New York State) the title must be signed by both parties in front of the dealer's representative, or a notarized form be submitted to the dealer attesting to the transfer.

When I was going through my divorce, I tried trading my truck because my ex and I had an agreement to get rid of or refinance all co-financed assets. While I was negotiating trade value on my truck, they came back in and told me I needed her signature to go any further. She wouldn’t sign off, but that’s another story. The dealership should have done their due diligence, and the previous owner committed some serious crimes (possibly federal involving banks, if there was a loan on it).

Stick to your guns regarding clear demands for adequate compensation, and let your lawyer handle communications. Any communications you have with them need to be in writing. A phone call and verbal deal hold no weight in court, should it go there.

Here is, hopefully, the last chapter to this story.
Got the phone call that they are taking care the bank and compensating me on my purchases for the truck. Someone mentioned earlier about how it would hurt credit; mainly opening and closing an account quickly. The dealership took care of this with the bank. But here is the news that all have been waiting to hear. The dealer said they will give me a truck at cost and had one in mind for me. First, here is what I had:
'15 3500, 85k, Big Horn, chipped and deleted, upgraded interior, long bed, leveling kit, for $47k out the door
Here is their new offer:
'17 3500, 24k, tradesman, has every upgrade possible for trim (Chrome appearance group , all the power option, diesel brake, 5.0 touchscreen , back up cam w/ park sensors , trailer brake, Bluetooth, XM radio, and a 36 gallon fuel tank vs the 31), aisin transmission, short box, for 42k before tax
Basically they are taking 6k off their price. I'm sure some would say they want more, others will say it's fair. I fall in for the latter because I am happy with the offer and want this all behind me.
To wrap up this saga, I'm green when it comes to Cummings and Rams....I have a couple of questions. One will be for the dealer but I'll ask them all with such a great group of folks here:
Do I get the warranties when buying used? (I know cpo's get them)
Is it true that delete kits are becoming harder to find? (I know this will void warranties if they do offer)
Are you guys fans of the aisin transmission? (I know little about them except that some find them coveted)
And lastly, anyone have any upgrades they made on their tradesman that they found enjoyable? (I really enjoyed the subwoofer under the backseat and alpine speakers in the BH)

Warranty transfers to new owner and should be plenty of drive train warranty left. Bumper to bumper probably done or close to it 3 years 36000.

Good to hear. Sounds like a reasonable deal on the replacement truck. As others have said, all the warranties transfer. About the "delete"... I know the government has seriously cracked down on the industry, but it is still out there. With all the focus on that, I would weigh the current climate and know that while dealer service departments in general will not hassle someone over mods when it comes to warranty, they would probably be tough on a tune.. I personally would wait until the 6/60 warranty (I think that is also the diesel coverage) is up before tuning. That said, I know very little about the diesel trucks... that is the realm of my son.. I use my truck for a very different purpose. It is more a big car for me.
The last thing I would do, since you are securing financing for the replacement truck, I would insist that the bank remove the record of the initial loan from your credit since it was voided anyway. And again, make sure you get their response in writing.
Good luck with the new truck, and glad you can move on..

Sounds like they're trying to make things right. You could ask them to throw in a bunch of upgrades as mentioned. If you liked the Alpine system check out the audio section and you'll find a lot of great information. It couldn't hurt to ask them to upgrade the head unit to one of the better ones as a start.

I like the idea of requesting an extended warranty. The dealer can easily provide this without much pain to them. You are entitled to a little peace of mind after what you've been thru.

I think he already has the hi end radio. What would turn my crank would be a upgraded warranty, but to me sound like the dealership is trying to do the right thing .

Sounds like a good deal. I'm glad they got it straightened out. 24k on a Cummins, that thing isn't even broken in yet.

24k is great. Like Loudram said, not even broken in yet. Free oil changes would be nice but think you mentioned the dealer is 3 hours away? How are the tires? If original maybe see if they will throw new tires on for you?

42K for 2017 you would of done a whole lot better sticking with a lawyer... Well, if your happy that's all that counts. Good luck with your truck.

Last update here for those who are still curious. I'll be brief.
Went to the dealer, got the truck. They offered same price as other truck which was close to 8k below what they were asking. They also threw in new tires after I pointed out how close they were to being done. The finance people also threw in theft protection, extended 5yr 75k warranty, and gap coverage for 2500. They also called the bank and lowered our rate to give us $30 back per month.
We left very happy how it all turned out. Now I just need to update my new tradesman! Keeping an eye out on the classifieds on this site for premium cluster, steering wheel upgrade, and 8 inch radio (dm me if you have some ready).
In the end, Dave Smith made it right.
