He left work at 2:30 am instead of 3:00 when he could call me while I ate to keep him awake, and this happened. 26000 miles and a little less than a year old, but it did its job. 4 airbags, lots of crumpling, and had to have the door prizes open so he could get out, but no injuries in either vehicle, but both total losses. He learned a lesson about staying up too many hours (I hope) and will be vehicle shopping as soon as this is cleared up with insurance. We are all glad he is ok, and that the amazing engineering and technology that goes into these vehicles is there and works. And that God is watching over him even when he isn't acting as maturely as he should.

No nagging Scottly. He didn't sleep the day before and had been awake for about 36 hours when this happened. He usually calls me or his gf on his way to and from work because he gets tired. He was supposed to call me at my lunch time, but left a half hour early for some reason. I'm just glad the call was the one it was and not something much worse.

If one's been up that long, he would fall asleep without knowing it. I had worked 12 hrs shift for over 15 years and to stay awake I would drive with windows rolled down in the middle of winter, slap my face etc. I was young. Nowdays, if I am ever in that situation, I'd pull over at a truck stop and catch 1hr sleep. Helps a lot. Glad everyone's all right.

Your right God was looking out for him, as he did me twice a long time ago for the same reason. Tired fell asleep totaled two different vehicles, luckily both times ran off to the right in a shallow ditch, what totaled them was jumping driveways.... and coming down hard but not hitting anything else. SO glad no one got hurt, ive always pulled over ever since. So much better to spend the night in your truck, than the alternative.

Going 24 hours without sleep is like being .10% bac. Basically, you're drunk. What do you think it'd be for 36 hours without sleep?

I don't think God was looking out for anyone. This guy was a damn fool for not having the common sense to get his proper rest. Innocent people get killed because of this stupid behavior.

You want to know why your insurance rates are so high? It's because on needless stupidity like staying up 36 hours, and totaling 2 vehicles.

You don't know why he was up that long to start name calling, sometimes life and work happen. I have been in situations where my dad was in the hospital having open heart surgery while I worked 12 hr shifts. Sleep was the last thing I worried about. Common sense and needing to do what is right in your heart is the way it is. Some people can function after 36 hours without sleep others can't, it's not you to judge.

Tell the kid a hotel room is much cheaper than a Deductible.
Added benefit, sleep less in strange bed, so wake up fresh and ready for day.
Go home, super tired, sleep in own bed and you're out for a decade b4 ya wake up all groggy and lethargic.
Anyway, Learning Experience and one not likely to be forgotten.

IMG_2217.JPG If that knuckhead that you're trying to defend, would have hit a UPS vehicle, and there was an injury or fatality involved, that UPS driver would have been fired right there on the spot. No more income, no insurance. I've seen it done. Twice.

What if he'd have hit a motorcyclist?

There is no excuse for driving after being up for 36 hours. Ask anyone with a CDL what the rules are, regarding hours of service.

If anyone knows more about what it's like to drive for a living, I'll shut up and listen.

Thanks for all the positive comments. The negatives, not as much. The point was that we are thankful for the situation not being worse. Hopefully a lesson learned by him, and by posting, maybe by others too. Took my 13 year old to see the vehicles when I helped him clean the truck out before insurance took possession the morning after. Used it and the others on the towing lot as a learning experience that she will likely remember for many years to come. Accidents happen, and we all make mistakes. He is 24 years old and thinks he is invincible. As many of us did at that age. Hopefully a wake up call for him. He has a beautiful little girl less than a year old to think of at home and I think he will think a lot more in the future. He knows that if he gets tired after work to call any of several people, no matter the time of day. That's what he was supposed to do that morning on his way home, but left early and didn't wait till I was at break to leave. All of the what if's and should have situations. His mother and I as well as others that care very deeply about him are just thankful that it turned out the way it did.

Glad everyone was alright. Someone was looking out for them that night.

While we all think we are invincible, what if the other person isn't. With today's crazy laws and prosecutions, an accident like this could have lifetime consequences even if you walk away without a scratch.

You didn't say whose fault it was and shouldn't and I don't presume to guess.

I am so glad for you and your family (and the other party's family) that it wasn't the "other" call all of us as parents dread to get late at night.

Back in 2003 I listed my '57 Chevy on ebay. a guy from Sweden contacted me wanting to come look at it. yeah right....well he did and he bought it. one stipulation was i had to trailer it to Elizabeth, NJ from Pittsburgh. no problem. i was working night turn in a steel mill and finished up Friday for my long weekend. Left work at 6:00AM and picked up my wife and kids. I was driving my 1994 F250 extended cab pulling my car trailer. Kids were about 9 and 10. Woke up about 6:pM Thursday night and went in to work at 8:00PM. We had mandatory OT so if I had went in at midnight like I was supposed to there was a good chance I would have got forced over until noon the next day so opted to go in early to avoid that. The buyer me me at my house. We got to Elizabeth about 3:00 in the afternoon. By the time we got the car unloaded we left there about 5:00PM. At about 1:00AM I was having trouble keeping my eyes open and my wife had never pulled a trailer before so I stopped at a hotel about 3 hours from home. No vacancies. There was a 4x4 fest going on and they told me all hotels around were booked up. So went ahead and let my wife drive and she was too tired so she pulled over at a hotel after about one hour. Nope. Full there too. At that point we were about 2 hours from home in Knox, PA. We made it home around 5:00AM. I had been up about 36 hours. I was seeing things on the side of the road that weren't there and jerking the wheel thinking I was going to hit them. I had my window down with my head hanging out. Kept pulling over to get out and walk around the truck. Nothing helped. Sleeping in the truck wasn't an option as it was too cramped and we tried the hotel thing. Didn't have much of a choice. I never want to do that again and would never advise it but we made it. I was about 35 at the time and would never even think about trying it at 50. But sometimes you do what you have to do. I was as careful as I could be and took all the precautions I could think of.

Glad everything was ok in your case. My son was just rear-ended Monday morning 1500 miles from home and his hitch is destroyed and he has to tow his camper back in 2 weeks. Everyone was ok but a distracted driver hit him. There is no way a body shop will have his truck fixed in time so now he has to figure out how to get his camper back here or to the next job site

I'm going to say one last thing, then I'm getting off the soapbox.

If your son learned something from this, ok.

But for the next several months, he is wide open for a nasty lawsuit. People sue McDonalds for the coffee being too hot. There are ambulance chasers all over that live for accidents like that one. I am here to tell you. If your kid gets sued over this, it's not a matter of wether he wins, he won't. It's going to be how big the check to the plaintiff is going to be. They have you on record, that he was impaired.

I was pulling a set of UPS doubles home one night in a snowstorm, and some drunk chick passed a cop, and hit my set. That's as clean of an accident as there could be, right? Liberty Mutual hounded me for months. Months.

Maybe I'm overreacting.... Honestly, for the sake of your kid, this thread should go away.

I say this respectfully because I think you're heart is in the right place, but you are overreacting. How would the opposing attorney become aware of this post? The trail would have to look something like: Deposition for the involved driver, ask who you discussed the incident with, father's name is given, father is depo'd, asked about social media presence, this post identified, this website served with a preservation request followed by a subpoena for the content and accompanying documentation that would allow it to be court admissible. That's a long row to hoe for a simple traffic crash lawsuit.

Risk vs Reward

What does the 24 year old have to gain, by it being posted that he was driving impaired, and caused an accident that totaled 2 vehicles, VS what he’d loose if he got dragged to court?

I lost count how many Daryl Isaac “The Hammer” (ambulance chaser) billboards I pass here in Louisville, but I’ll bet it’s over 30.

Years ago I was on a Yahoo message board where a guy was talking about a criminal trial he was sitting in the jury of, and he made negative comments about the defendant. Someone on that board contacted the court house, and it caused a mistrial. If I were the OP I would make this thread go away. Also thank God every day that this wasn't a fatality. Driving without sleep for 36 hours is crazy!
