Risk vs Reward

What does the 24 year old have to gain, by it being posted that he was driving impaired, and caused an accident that totaled 2 vehicles, VS what he’d loose if he got dragged to court?

I lost count how many Daryl Isaac “The Hammer” (ambulance chaser) billboards I pass here in Louisville, but I’ll bet it’s over 30.

Any attorney who's going to go through the lengths to find this post and the hoops to make it court admissible is also going to ask in depositions about sleep, medications, health conditions, etc. Then the choice is admit to sleep deprivation or commit perjury. The Hammer might go through the trouble for a commercial vehicle causing injury (deeper pockets) but it'd not be a money winning proposition for a property damage or minor injury crash.

I know more about the criminal side but I've been sued and/or deposed for civil suits as well, including for wrongful death. Believe what you like but this is well within my wheelhouse and you're overreacting.

Years ago I was a working part-time in law enforcement but was on work comp from my full-time job. While on work comp I was not doing any other work and was following the rules but I was a an LEO forum talking about LEO stuff. Went to a work comp hearing and they brought up the forum stuff and had printed it all out. I was not using my real name anywhere but somehow they found it (likely linked to my email address when I registered) but I was shocked that they had found that. I wasn't doing anything wrong but it they did put the effort in. They had also hired a PI to follow me around. I caught them one day but at the one hearing they handed over the 2 VHS tapes and their written report. Nothing incriminating in there for me either but they did it.

Sorry to cause all this "concern" but everything stated on here is in the report. He was forthcoming at the scene with the other party and the authorities as well. I also reminded him that his insurance company will also have access to whatever info is stored in the vehicle concerning speed, GPS location, etc if they choose to look at it. I mentioned this to my done that I posted this and he was of the option that it should be a reminder of the importance of not doing what he did and that these vehicles are made to protect the occupants in such a case. Nothing to hide on his part. He knows the potential severity of the situation had it turned out different. If there had been any question of injuries or fault, none of you on this forum would have known anything about it. It's mostly a reminder to all to not put yourself in situations such as his because of the danger to yourself and others. I really didn't want to start any controversy at all.

Sometimes you gotta do what you gotta do. A few months ago my son's company sent him 1500 miles away to North Dakota. He had to report to work there on a Wednesday morning and was 200 miles east of home and his company made him work 1/2 day Saturday. He had to get back from work Saturday afternoon and get his camper all packed up and leave Sunday morning. He drove about 10 hours each Sunday and Monday about 5 hours Tuesday then get his camper all set up. If he had driven any less than 10 hours a day he may not have made it to work Wednesday morning. He explained the logistics to his company and they didn't seem to care.

There are very few people alive that hasn't done something stupid at least once in their lifetime.
It is the learning from those dumb choices that is important.

10 hours a day? That is less than a commercial truck driver is legally allowed, so no wonder the company didn't care.

I did all kinds of stupid **** in my youth. Luckily no one was seriously hurt by my poor life choices.
I know first hand that you learn more from your mistakes than you do by getting it right all the time; and anyone who claims they have never done anything stupid in the past is lying to themselves.
I’m glad your son is ok, and I’m sure he’ll become a better person as a result of his mistake.

10 hours a day in a truck he just bought a week earlier and having very little towing experience on his first long distance solo trip with a deadline from his company puts a little more pressure on it. On top of that he only had about 10 days notice of the trip and he was getting married a few months later. No pressure at all.

I can see both sides of this.

On the one hand, kids are young and make poor decisions. That's how they learn. Kids learn by re-making the same mistakes us old fogeys made when we were young.
Stupid games = stupid prizes.

On the other hand, if it was your daughter that got killed when some random stranger fell asleep and clobbered her, which of the above excuses would make it acceptable to you?

During the Nuremberg trials, it was set in stone that being ordered to do dumb ****, even if legal, doesn't get you off the hook for the results.

If ordered to do something bad, even under penalty of death, once youre to the point of killing Innocents, you have a responsibility to disobey those orders.

On one hand, people make mistakes.

On the other hand, we still punish these mistakes to minimize the frequency and/or magnitude.

I have been driving under extreme duress for many miles in my younger days and the only reason I made it home ok was God looking out for me. To many life stresses at times and not enough brains for me to pull over to sleep. I have run into a concrete
barrier at speed (my fault) and the only thing that I had going for me was a roll bar and 5 pt harness. It hurt terrible for several days and I NEVER mentioned this to my cardiologist ! Totaled my Duster.
I am very thankful for the safety equipment in that RAM truck (and the Jeep!).
I have been in too many wrecks and just don't want to be in any more.

I'm going to say one last thing, then I'm getting off the soapbox.

If your son learned something from this, ok.

But for the next several months, he is wide open for a nasty lawsuit. People sue McDonalds for the coffee being too hot. There are ambulance chasers all over that live for accidents like that one. I am here to tell you. If your kid gets sued over this, it's not a matter of wether he wins, he won't. It's going to be how big the check to the plaintiff is going to be. They have you on record, that he was impaired.

I was pulling a set of UPS doubles home one night in a snowstorm, and some drunk chick passed a cop, and hit my set. That's as clean of an accident as there could be, right? Liberty Mutual hounded me for months. Months.

Maybe I'm overreacting.... Honestly, for the sake of your kid, this thread should go away.


So what type of work did you go into when you were fired from UPS for being hit by this drunk driver? Such a shame for 25 years of safe driving down the tube.

With a CDL you don’t have to cause the accident just be involved in it. An accident and any other violation is a 6 month suspension of driving privileges. Everybody needs to be on the same system. Would be a lot less chances taken. I retired and in March this year turned in my CDL. I feel like I just got out of prison.
Glad to hear your son is ok. Physical properties can be replaced or repaired.

jendsley06, I'll not pontificate suffice to say I'm glad all concerned are well. Thanks for sharing the pictures of the vehicles. Since we purchased our 2018 3500HD, I have wondered how it will hold up in a collision as compared to our 2001 2500 QC. You are right, it looks as if technology did its job. Vehicles can be replaced, lives can't.

I'm glad he was alright, but are you sure the right lesson was learned? The correct answer is NOT "talk on the phone when exhausted and hope that keeps you awake". Regardless of why you were up for a long period, the responsible thing to do is sleep before you get behind the wheel.

One of my classmates in high school ran out of of gas. Called dad who promptly arrived with a filled gas can. Son was filling up car on the side of the road, and a driver fell asleep and drifted over. Son was killed instantly and the father got to watch the whole thing happen.

If you know you are tired and you still get behind the wheel, you are just as at fault as someone getting completed hammered and then getting behind the wheel. That is the point that should be driven home, not just that he should call next time.

Have I done stupid things? Absolutely! I'm just posting to make sure he knows just how stupid it was. Please take this in the manner it was intended - not to judge, but to hope he learns the right lesson from it. Hope this helps.

What if he'd have hit a motorcyclist?

There is no excuse for driving after being up for 36 hours. Ask anyone with a CDL what the rules are, regarding hours of service.

If anyone knows more about what it's like to drive for a living, I'll shut up and listen.
I agree-Bravo for your son for working long hours -he should have taken a cab or uber home--He could have killed many innocent people aswell as himself--you act like your proud of your son for working long hours-but res
