Dealer want to cheat me or not? Need help pls

Hi all

First, sorry, I am not an English native speaker and I need your help. Maybe anybody have legal knowledge too?

I bought my truck at 2017 and the dealer sold me an undercoating/rust protection package including a lifetime insurance for (better against) Rust.

Every 2 years a free inspection is needed to keep this insurance . Now I asked for the second inspection, but the Car dealer told me – the Coating company don’t exist anymore,, there insurance don’t exist anymore too.

But – The insurer is the Caar dealer, not the “Maple Leafe Car Care Products” Company.

After a hard discussion with the service manager, I spoke with the financing guy. He will give me an info via email what will be the next steps, he has first to check the facts.


I am right to want my free 2y inspection and what I paid for – the lifetime insurance or he is right, all is done?

It says right on the paper the insurer is Derrick Dodge, I would wager the best you can hope for is your money back. If it was in the states, a judge would charge you something for the service you received but would give you some money back for what you didn't receive. Do they have small claims in Canada? If it was me I would have already filed one here and caused a f'n stink they wouldn't forget.

Then look up dyi fuid film thread here, that stuff kicks ass, as long as you do it every year you wont have any rust.

In the states if you received profit from something you sold such as this service, you can go after either party, the dealer or the so called rust company, which sounds like a complete joke. The dealer not only made money on this but also was the applicator, as in the service was done at their shop? just file a case.

Contact CTV Edmonton and Edmonton GLobal News,get Derrick Dodges name splashed on the nightly news,odds are they'll give you your money back .At least threaten to go to the local TV stations,most dealers change their tune pretty fast if they think they might end up on the local nightly news

Yeah I would press them hard for a refund its not your fault the company went out of business. Dealers do not like negative press so they will likely do the right think if they are smart.

The "Warrantor" is not the dealer but the dealer is the Insurer so they are on the hook for rectifying the issue.

Don't go lighting them up in local media just yet. (Yes, this will work.)

You have to give them a chance to make you whole on what you paid for a service/product and warranty. If they refuse to do anything such as replacing the coating or refunding you a portion of the then take them to the Canadian equivalent of what's known here in the US as Small Claims Court.

Let the court review the document and any other documentation that they will ask of you when the claim is filed. This usually includes the warranty document you posted above and some form of proof that you actually paid for the service or product.

Make a call to either TV station,you can try small claims but you'll be ******* running to court filing papers etc. Hit up the local TV stations first .Dealers hate bad publicity.That's if you don't get anywhere with the financing or service departments first,let them try to make it right first,if they don't,tell them you're going to the local media,that'll get their attention faster then threatening them with small claims.
You're in Canada,we don't have many resources,so you gotta use the ones that get the dealers attention.Amvic is basically a joke,as it's dealer financed

Looks like the dealer is on the hook to me, but they can claim that you didn't get your inspections done - since they won't do them because they can't because they have no product.

They should reimburse you for some of the cost (in some form) if for no other reason than it would be the right thing to do for you, the customer.

Imagine how many of potential cases there are if this went on TV.

Technically the dealer can say the warranty is void since the customer failed to have it inspected within 24 months of application. It was applied Feb 15, 2017 and was not inspected until Feb 25, 2019 which is 24 months and 10 days. I suppose if the dealer wants to be a jerk they can void it on those grounds.

If they cannot provide you with a service that you paid for, then you should be refunded what you paid.

I hope you get it sorted out.

Derrick Dodge the dealer he's dealing with has a ****** rep ,and i'd highly guess he won't get anywhere with them by being a nice guy.

In an Alberta RAM group in Facebook I got some hints too. One guy texted “reason #845 why I won’t go back to Derrick dodge lol brutal dealership “ . second guy “**** yeah man I had a bad experience too. Shady shady people.„

Derrick Dodge f... me now the second time. First time was - they promised me a 90 day payment brake at the beginning. I got direct an "unhappy" letter from the bank, because I didn’t got this payment brake, but I didnt know this. Derrick played than "Stupid-Customer tennis" with me. Talk with person A, A said talk with B, B said talks with C, C said talk with D, D said.......... etc. There was no sorry, nothing. If they offerd me a free free oil change as a sorry or even 50% off for the first oil change, I would be ok, but so????


About inspection at February 25th 2019 (they changed anything, maybe it was the March? I don’t remember) - I was there early enough there to ask for an appointment and they didn’t gave me an earlier one. If they give me a later appointment, they automatically accept its later. Not my fault

That definately sucks, but at least the OP has some options. Might take a bit of negative publicity then to get the dealer to do the right thing.

Hopefully the dealer at least DID have the work done in the first place. Sucks that they have such a bad rep, I do hope for the best possible outcome for the OP.

For the people saying to get a lawyer......those people have obviously never had to hire a lawyer before because you will quickly rack up more money in paying the lawyer than what this undercoating is worth. The cost of the lawyer would probably pay to go to another shop and have rustproofing applied.

And good luck on contacting a TV station and having them go to the trouble of running a news story on this. Try it and let me know how it goes........

I think the above ^^^ is how it would go. Lawyers aren't cheap and most TV stations don't have the staff for this anymore and probably don't want to offend an advertiser/potential advertiser anyway. Be careful about what you publish as it can come back to bite if there's a technicality in what you do.

Try the upfront approach suggested and small claims if it's available.

It's just hard to get a resolution for low cost issues.
