My insurer is Mercury. The person who hit me is with Progressive if that matters.
Don't understand why you are bringing up your insurance company. If you got hit from behind, the other drivers insurance is responsible for repair and yes you can demand OEM parts. It is less than the minimum dollar amount os insurance required which is $30,000. carafe, of me He He..

Just kidding of course..demand oem if your not taking it to the dealer for repairs ...shouldn't be an issue if you hold fast to your demands.

Probably because in some no-fault states, like New York, you file a claim against your collision insurance and then your insurance company submits a claim against the other person's insurance.

Not always the case. Years ago I smacked into the back end of a Ford Club Wagon and it was deemed his fault, He was, however, pulled onto the median strip to the left of the fast lane removing his chains, then pulled out in front of me and stopped blocking my lane. I hit his right rear bumper, then a Cadillac hit me from behind. All because he was illegally parked on the median strip and failed to yield to oncoming traffic. I did total my car, which I had only bought 5 days prior. His insurance just paid me off.

Friend of mine just went through same thing, progressive was the other person's insurance. The repair can be done with aftermarket parts that are OEM spec or even with used parts that are graded A with no defect.

My recommendation is go to a Ram dealer repair center. They get the best price on OEM and may be able to get you into a OEM bumper for little to no cost out of your pocket. There is most definitely additional damage, likely where the brackets mount to the frame and possibly the frame itself. Can't expertly speak to every state's laws but my experience and knowledge of insurance policies and regulations is that there isn't a way to demand OEM, you get what the state and policy allows; I was involved in her claim to listen in and I asked adjuster who said he isn't aware of any policies that let you purchase a OEM rider.

Experience with Progressive was they dragged it out, they can take 30 days or more to "investigate". She turned it in to her own insurance and even though it went as a ding on her experience rating it was worth it to get it fixed. It will then go though mediation between the insurance companies. The process involves subrogation and your insurance company should fight for the additional amount due you for the value the truck loses with the history of the accident on the record.

You of course can pay out of pocket and hope Progressive eventually reimburses you, but based on some trexis insurance reviews, it’s best to confirm your insurer’s reimbursement process first. Under insurance, the original estimate will start the repair process, and then the teardown will result in an additional supplemental request and payment.
Aftermarket certified bumpers can be lower quality than OEM, sometimes with fitment or durability issues. You can ask your insurance company to use OEM parts, but approval depends on your policy and local regulations. And yes, your Carfax will likely show the accident once the repair is reported.

It is Progressive whose client Hit YOU …correct? THEY are liable to YOU for damages…correct?

Progressive is HOPING you’ll let them substitute aftermarket parts ….which will DIMINISH the value of your vehicle.

YOU have the right to INSIST on OEM parts. Do it. IMO

If the vehicle still has warranty, who could expect the manufacturer to warranty a part or parts that they didn't manufacture? They will still look for an "out" for future claims. Any trace of warranty left on the vehicle, insist on OE parts only.

Yes that matters! Progressive is the cheapest Insurance and owned by George Soros, When I ran shops, Progressive was always an argument (fight) Contact your company and ask them if they will pay for am/kt parts. A lot of times your company will pay to fix your vehicle, then go after the adverse insurance. Also, a LOT of the dealers will price match the am/kt parts. I disagree with that, but that's what they do. Lastly, Go after them for diminished value. depending on the amount of damage, mileage and value you should be able to get diminished value. USAA offers it to both the insured and claimants' vehicles. IF it is only a rear bumper, and no other damage, be sure to keep a copy of the estimate and if and when you trade in the vehicle, you can show them the damage.
The dealer will tell you that you have lost a "stupid" amount of value, but you must be realistic in the amount. That's mainly so they can lowball you on trade in, then jack the price when selling it.
When I traded in my 2016 it had been hit in the left rear, new bedside only 2 months old. The I told the dealer it was hit on the right side, they said, we can't tell any difference. I then told them it was the left side that was hit and a new bedside was installed.
Your insurance will fight for you! They have a contract with you.
Also, IF the am/kt parts are used and they don't fit like OEM< make them pay to do it properly with OEM parts! YOU are the final say if they fit to your expectations, YPU must be happy with the repairs, and do not take it home and then try to negotiate for OEM parts. Get a supervisor involved if needed.
Like I said I ran shops for 40+ years and had to deal with all kinds. Some good, some not so good.
