I had a 2003 that I thought the same exact thing, that the latch was broken. Turned out that a shim on the right side was missing and when I put a washer on the pin at the hinge point it shifted everything over and worked fine.

Check the gap on left and right side with tailgate up as far as you can get it. Are they equal? When you get tailgate up have someone lift left and right side from bottom, does tailgate then shut and latch? These can be signs the latch is fine and it is the alignment is off. Good luck

My latch on the left side drops back down. I have to manually pull the latch up while lifting the handle and hold it until I get the latch almost to the striker and then push the tailgate closed.
