2012 trans questions

I have a 2012 ram hemi with the 6 speed trans. Having a couple of issues with it. First after sitting for 8 hours or more when I put it in gear it takes 8/10 seconds for it to engage. One time when it did engage I heard a grinding noise and then it showed a 4 beside the shifter position. Turned the truck off waited a couple of minutes and restarted the truck and it was fine. Truck is now at the dealer and they are telling me when I had the trans serviced, filters and replace fluid, that they used a gasket instead of silicone to seal my pan and that caused my fluid to leak out. When I took it to the dealer they check all my fluid levels and they were fine and after checking things out for 2 days they are now telling me it had no oil and they are going to have to rebuild it. Not real sure but this sounds like a bunch of BS to me. I have been past the dealer twice now and my truck is sitting out side. They said it would be done Friday. Not sure how to deal with it.

1) who serviced the transmission?
2) are they warrantying the rebuild?
