+1, it can be, yup! That and in a lot of areas now, its illegal to have it in if you aren't towing. Whether the police enforce it or not is dependent on the area too, but if you're in an accident in an area where its illegal, they will take it into account.

from what I googled it is only illegal in a few nanny states IF it blocks the plate.

This. The few times that I do forget to leave it in I end up slamming my shin in it forgetting that it’s there. The reason enough for me to take it off every time even though I like to use it as a step if I need to get into the bed.

No, they actually got them paintable - and painted them to match!

I am currently searching for a brush guard and a rear bumper guard that's hitch insertable for this very reason, bad drivers and deer.

When I was at Ft. Riley circa 2007ish, I had an 01 F150 and had a similar accident, rear-ended by another F150 and pushed into a mustang. The mustang was totaled out, truck had like 3k in repair, very little damage. I even claimed damage to things that were already jacked before the accident like my windshield being cracked.
