Dude pulls out of parking row onto access lane, runs right into the rear of cab drivers side of my quad cab.

Driving someone elses car.

Driving on a suspended license.

Cop says he didnt see him driving, so can't take him to jail. I said, "I saw him driving, can I make a citizens arrest?" Cop said, "No". D-bag gets ticket for driving w/o license.


Tag on car does not belong on that car.

Cop said they cannot even ticket for that because of a Supreme Court ruling.

No insurance on car.

Gets ticket for no insurance. Also gets to park car and is told to have it towed. NO IMPOUND.

So, my insurance collision deductible is $500, guess who pays that? Me. Plus, uninsured motorist only pays for injuries, not damages or losses.

So, It appears that my only recourse is small claims court and a judgement. More money, more lost time. But might do it for the pure joy. Maybe I can file a lien against him and owner of car.

How about that?

My nephew and his parents went through something similar last year.

Uninsured driver in her expired registration car rear ended his car in traffic on the highway.

Car was totaled, but with no insurance and apparently nothing to her name, my in laws insurance had to bite the payoff (minus deductible). The car was old but ran perfectly and was in great condition.... The age just killed the value so the cost to fix it made sure it was totaled

Rules and laws are great. For people that actually follow them.

That sucks big time.

Might be time to talk to a lawyer to see what other legal options you have. If they offer a free consultation, you have nothing to lose.

A few years ago I was rear ended by a driver with no insurance. Thankfully I was in a company truck, not mine. My boss just fixed what he could. He didn't go through his insurance.

From a cop, you can't ticket someone for driving w/o a license and claim you can't ticket them for driving while suspended. That's the same damn thing. To me that's just someone being lazy and they don't want to arrest the guy and have to take him to jail and write a report on it. I'd call the chief or sheriff and complain on that one. How is he going to issue the guy two tickets that clearly show he was driving, then say he can't on another ticket. He can issue a ticket for concealment on the tag because he was trying to conceal the identity of that car with the plate of another. I'm pretty sure FL is close to GA when it comes to traffic laws. How do they get murder suspects with witness statements and take them to jail? Because of the witness's statements. That's how he could've arrested and charge him with suspended. Sorry you got dealt a lazy local. State guys wouldn't do that to ya.

I have a consultation this afternoon.

I'm sure small claims is probably the only recourse, but if not too expensive will go for the judgements, plus my costs, too.

Dude pretty much admitted everything.

Oh, and this will be his 3rd ticket for driving suspended in less than 2 years. 2nd time was noelle prosssed.

I told him how much of a ************* he was, in front of the cop. But it doesn't matter, because he will keep doing the same **** untill someone is seriously injured.

Sucks when you don'y have alot of money and bust your ass to have and keep nice things, and in an instant, some pos screws you over.

While it may be emotionally satisfying, you can’t get blood from a stone. People like that are akin to the homeless of the motor vehicle world, inadequate resources and bad judgment. If he’s arrested you’ll just be picking up the tab to feed and house him. Although likely we all are already.

Just an observation, I’m not smart enough to know what the solution is.

Not sure how it all works in FL, but you might want to keep an eye on your mail for something from your Bureau/Department of Motor Vehicles.
It was quite a few years ago, here in Indiana, but I was involved in a similar situation. Accident was the other driver's fault (she ran a red light), she did not have a valid license, or insurance. I was in a company truck, and showed the officer both the company insurance, as well as my personal insurance, and all of that info go put on the police report. A few MONTHS later, I received a letter from the Indiana Bureau of Motor Vehicles that claimed I didn't have insurance, and that if I didn't provide them with proof of insurance, my license would be suspended. I knew the Sheriff at the time and asked him about it. He said that it was standard procedure for the BMV to send that letter to anyone involved in a traffic accident, regardless of what info was on the police report.

The scary part is that I had just moved back home after collage, and my mail was delayed getting to my new address. I got the letter just a few days before the deadline to show proof of insurance. If it had shown up any later, or not at all, my license would have been suspended without me knowing about it.

Yeah, realize that. But damn sure will file a lien with IRS on him and owner of car. Hopefully can get some of their tax check down the road.

I was involved in much the same kind of incident in a parking lot many, many years ago. I had just gotten my Pontiac Lemans and got T-boned by an Oldsmobile in the right rear quarter panel. A Virginia State Trooper happened to be in line at a nearby bank when the call was dispatched and showed up within a couple minutes.

The guy who hit me was very old and IMHO had no business being behind the wheel. Thinking back, he was a lot like Mr Burns from the Simpsons cartoon. He apologized, admitted fault, and said he didn't see my big bright red shiny car passing in front of him. Trooper King said because it was private property, he couldn't issue a summons, but did get our drivers licenses, insurance information, and completed a full accident report. He told me that if the insurance company gave me any trouble to call him and gave me his card.

Sure enough, a couple weeks later, the guy's insurance sent a letter stating that Mr Timberlake denied being at fault and that they were denying my claim. First I called his insurance company, then I called Trooper King. Soon after I received a call from Mr Timberlake's insurance company apologizing and stating that they would be paying my claim.

Later, I did a little research and learned that Mr Timberlake was very successful in commercial real estate. He could probably covered the cost of the damage out of his wallet. D-bags are everywhere.

tax money! You need a job to pay taxes and with a suspended license, no insurance, and all his other good deeds you know he doesn’t work! Living off our taxes for sure.

Lots of people get "free" money that they never paid in.

So, all of you are going to pay it, then. :D

I know it probably won't be cost effective to do, so we will see.

Boy, don't I know this. We've had FOUR accidents in the first year living in horlando. Wife had her 10 year anniversary Miata totalled at a red light by an uninsured driving her parents car. Got a 5 digit settlement suing the parents. Had 2 parking lot H&Rs on my F350, and a rear end at a light, where the other car backs up and takes off, half on the sidewalk, and all i heard was "arriba arriba, endaley, Endaley" as they drove off, except I had a 4x8 bolted to a plate in the class 3 hitch. I had splinters, he left a good amount of plastic and glass on the ground.

Need to change insurance or look into updating it. Had a guy slide into me from icy road. The roads were bad that the police would only respond to accidents with injuries. I took a pic of the insurance card that he presented (didn't have anything to write on). I didn't see that it expired. My uninsured part of the policy took care of everything but the deductible. Then about 6 months later I had a credit. The insurance got it from the other guy.

Also you can request a supervisor at the scene. Sometimes Officer Lazy will change his tune without even having to get the super.

Wife has a 'friend' that has been cited about 7 or 8 times in about 5 years for driving without a license and without insurance. Last time she was supposed to go to jail but because of COVID it was rescheduled then when she went back she got another extension. We are guessing she claimed she had COVID so she couldn't go to court. Her son also was caught twice for driving without a license.
