YesTypically, you don't charge sales tax online unless you have a physical store that sells the items you're selling online. They have an address, but they only sell online. You can validate this by taking note that on Amazon you won't be charged sales tax unless the distribution center that you're item is coming from happens to be in the state you're in.
There is really nothing WRONG with charging sales tax, however; they aren't even registered as a business under " painted fender flares " , they aren't paying that sales tax to the texas comptroller nor do they appear to have a license under that name with the city of houston, or harris county. So yeah, they are charging sales tax, and basically pocketing an extra 40 bucks per sale.
yeah... no. That's not the same thing as this. They are taking sales tax, but are not a registered business in the state. The Spreme court merely said " you can take it because it benefits your state " . It's 100% not okay to take sales tax, then not pay the state. Texas is a franchise state. Meaning every small business has state franchise taxes, and even then, they only pay those if they generate more than 2 million dollars a year. Collecting sales tax on ALL states to pay texas taxes would be one thing, but the fact they don't have a license to pay ANYONE just means they pocket the cash. It's shady. Though, it happens all the time.
