HIT a Pedestrian...

Coming up an on ramp into 50 mph traffic, nobody in front of me, and only 1 truck in the right lane (merge lane) beside/behind me. As I am working my way up the ramp and looking in my mirrors and over shoulder checks, I get into my lane - look forward - and OH $H!T there's a guy crossing the road L to R. I swear to God he was dead center in front of me. I manage to swerve hard enough that he tags my mirror and gets spun around. I almost ran dead into a light pole but got stopped in time. He was able to get out of the road, and police/ambulance arrive to determine has has no injuries

Aftermath: He gets a ticket for being stupid, and go figure - hes an illegal alien. No insurance to claim against, I need a new drivers mirror for sure, and I need to clean up the drivers side window but it might be damaged too? Also lots of scratching and crap where the mirror dangled after it broke off. Paint needed too Still so thankful I was able to react and not kill this guy.

I'm not a lawyer, but that's how the cop explained it to me. "His Mom doesn't have insurance, he doesn't have insurance; so depending on your deductible you may be better off paying for repairs out of pocket". Didn't make a lot of sense to me either. Going for a quote tomorrow if I get the time.

Auto insurance isn't the only kind out there. I have an umbrella policy that would cover anything I'm liable for that another type of insurance, such as auto or home owner's, wouldn't cover. Its cheap for what it gets you.

Its still possible to sue a pedestrian, and if he's a minor his parents would be liable. If they are illegals, could luck collecting though. No insurance to pay out means they are on the hook for it personally, and with no SSN and the ability to change their name at will, garnishing wages, etc. is probably not going to happen.

I'd be happy that no other damages were done and that the guy is alive. I wouldn't want that over my head even if it was his fault. I'd pay the damages and move on.

wow...this is the American we live in, paying for other people's bs. oem mirror will set you back 3 to 4 hundred easy and if the paint is damaged too bad, you will be surely refinishing some panels.

Certainly the issue I have is not about the $$$, I really am grateful that I was able to swerve in time and avoid having this young mans life on my conscience. I wish it never happened, but that's not changing anything. I am also concerned about the wire that was severed that powers the mirror. I hope it is not part of a larger set of wiring. This was a sport model with auto dim, power, heat, and matched paint. I saw another thread on here where someone had found them for +/- 320.

I had to replace the same type of mirror, contact the dealer, they'll ask for you vin and that will get them the correct part number for your mirror (this # includes correct paint color). Then just google that part #. I think the dealer wanted around $700 I got it for $325ish I believe.

Your insurance should cover it. That would be scary. Crazy people walk in highway/interstate all the time. One got tagged on I-35 in downtown KC last weekend. It didn't end happy. Sad for everyone involved.

That sucks!! I was at PC beach this past weekend (spring break) and I recall my passenger side mirror getting hit and a couple drunk ass rubbing their heads, as im creeping down the strip lol it would be cheaper to.buff the scratches and buy a new mirror. Especially dealing with insurance companies.....

That sucks. You should bring up a lawsuit to the town for it and they will most likely give you 5k to settle and leave them alone. I work in a town with more illegals then legals and people do it all the time.

My first storm plowing a few years ago I had a mexican run in front of my truck. Messy. Those scares are no good glad everyones ok.

Got my insurance co notified today after my estimate. Need to replace mirror and driver side window, window tint, repair dents in fender and driver door, paint fender and driver door, replace wiring harness, replace trim and weather strip - $1958.00 total / $500 deductible.

That sucks that your truck was damaged. Who knows what this idiot was thinking crossing an on ramp, that's about as dumb as it gets. I had a similar situation last year over by North High School in Des Moines, IA. There's a little bridge you cross heading northbound towards the school and right as I was about to get completely across the bridge some guy just inexplicably came walking out in front of me. Thankfully nobody else was around me in the other lanes so I was able to swerve around him. He waved as if he was sorry. My guess was he just somehow didn't see the giant black RAM or hear my 14" Magnaflow exhaust and didn't mean to walk out in front of me.

My situation though no blood, no foul. Definitely not your fault in your situation, the foul being on the part of illegal idiot walking out in front of you. Stupid that you're probably going to have to shell out your own money to pay for damages that were his fault. It's like you're happy you didn't accidentally kill the guy, but at the same time it sucks because your truck is damaged.

I will have a set of mirrors for sale in about a month. Im ordering tow mirrors, and mine have puddle lamp, signal, heat, power.....pm me if interested

It sucks your having to pay to have your truck fixed because of someones stupidity.

On most interstates ,expressways major highway there are signs that CLEARLY say NO PEDESTRIANS ON HIGHWAY.

I would make sure he gets all the tickets for that and anything else he can be written up for to teach him a lesson!

So he does not have insurance,take him to small claims court and at least get your deductable out of his stupid A$$

If you take him to court and the judge finds out he is illegal, made he will get deported!!

Wow! Lucky you did not mame him. Your insurance company will be so glad that you did not kill the guy or hurt him. The liability can be in the millions. where as the damage to your vehicle is no comparison cost or liability wise. My wife ran over a weed wacker (gas power one) and she was found liable. The insurance co paid for the fix but it went into their records as her fault. If she tried to avoid it she would have probably totaled the car and others. Go figure. I would nix the insurance personally but now you may have to worry the guy doesn't sue you. Stories change, and hopefully the cop wrote a report and he really is not hurt.

The other side of the coin is that you might have helped out ICE and took the guy out.
But that would be hard to live with.

If the cost is high enuf that the insurance co will pay for it (deductible?) then you may want to go that route, but most likely they will blame you and it will count against you.
