I'm not all that knowledgeable in gen 3, but it sounds exactly like my 16 did before i had the top speed limit in my ECU raised from 105mph to *** mph.
Good news is i don't think your ecu is locked and a hand held programmer is all that you need to remove or raise the limit.
Need a gen 3 guy to confirm tho.

Sounds like a governor. 2 and 3 series were built and geared for towing not speed.
